Summary

On 21 July 2023, a Boeing 737-800’s transponder failed during cruise at FL 350 but the indication that it had failed was outside the pilots' normal field of vision, with no corresponding annunciation on the primary navigation displays or system status panels. Controllers in a low workload situation did not detect the loss of traffic from their displays and forgot about the traffic. The flight subsequently lost separation against an Embraer 190 which crossed in front of it at the same level. ATC collision risk detection processes and the 737-800 aircraft type transponder certification were both deemed inadequate.

Description

On 21 July 2023, a Boeing 737-800 (EC-NGC) operated by Albastar on a scheduled international passenger flight from London Stansted to Tarbes, France, as LAV 4651 and an Embraer 190 (F-HBLD) operated by HOP on a scheduled passenger flight from Paris CDG to Bilbao, Spain, as AFR21YB came into close lateral proximity in day visual conditions (VMC.) The two aircraft were on crossing tracks after the Boeing 737’s transponder failed without the pilots nor air traffic control (ATC) noticing. The investigation found that that measures intended to reduce the risk of errors in this situation did not function as expected.
